On January 20, 2026, EPCOR Water New Mexico Inc. (“EWNM”) filed an application with the Commission requesting the Commission’s approval and authorization to proceed with a Public Benefit Credit Facility Agreement (the “Credit Facility”) with the New Mexico Environment Department (“NMED”) pursuant to the Legislative appropriation made during the 2025 Legislative Session at Chapter 159, Section 28, Subsection 22. Under the Credit Facility, NMED will loan EWNM an amount up to the full twelve-million dollar ($12,000,000.00) appropriation to plan, design, construct, and operate additional water source, line extensions and service connections in Curry County, New Mexico (“Project”). The Project targets private wells at risk of contamination by per- and poly-fluoroalkyl substances and increases the availability of clean water to residents and properties that would not otherwise be served.
EWNM’s application and supporting documents are accessible at the Commission’s e360 case management system under Docket Number 26-00006-UT.
No action is required on your part unless you want to become a party or comment on the application.
The major events for public participation in this matter will occur as follows:
A public hearing to hear and receive testimony, exhibits, and legal arguments about the application is set for February 26, 2026, commencing at 9 a.m. The hearing will be conducted online and can be viewed via livestream on the Commission’s YouTube channel and its website, https://www.prc.nm.gov/public-hearings/. Please contact the Commission for confirmation of the hearing because hearings are occasionally cancelled or rescheduled.
People who are not associated with a party to this case may make written or oral comment as allowed by Rule 1.2.2.23(F) NMAC. Written comments must refer to Docket Number 26-00006-UT and be submitted before the Commission makes a final decision. Written comments should be submitted online through the e360 filing portal provided below. Comments can also be sent via US mail to PRC Records P.O. Box 1269, Santa Fe, NM 87504.

If you wish to appear in this case as a party, you must file a motion for leave to intervene, pursuant to 1.2.2.23 NMAC, on or before February 16, 2026. Intervenors must become familiar with the rules regarding practicing before the Commission and all other applicable rules.
